(“Kingtana’’) Kingtana is committed to providing superior product durability and quality so that you may achieve well deserved sleep and rest. If the Kingtana® mattress was sold new in the USA by Kingtana or a Kingtana® -authorized re-seller, and is defective due to faulty workmanship or materials, Kingtana® warrants that, at Kingtana’s option, it will replace or repair The Kingtana® Mattress. This non- transferable warranty is for the original purchaser only and is expressly limited as described herein. Kingtana undertakes no other responsibility and all other warranties, either expressed or implied including specifically the implied warranty of fitness for a particular purpose and the implied warranty of merchant-ability is hereby waived and disclaimed.

This limited Mattress Warranty extends to mattresses manufactured by Dreamy Bed Inc. (“Kingtana”) this warranty extends from the original purchase date of the original product purchased, and original purchaser. This warranty is valid only if the purchaser is an individual who thereafter uses the product for personal consumer use. The warranty no longer applies after any resale of the mattress whether new or used. Original proof of purchase (including date) by the original purchaser, this warranty document, and the law tags from the mattress will be required to make a warranty claim. For warranty service, you are required to preserve these documents during the 15-year warranty period. This warranty applies to the mattress and not to any accessories or other products associated with the mattress. This warranty is applicable only to mattresses in normal in-home consumer use, and specifically excludes any mattress used for a medical patient. Beds replaced due to warranty issues will not be eligible for model upgrades or downgrades; Kingtana® warrants that, at Kingtana’s option, if we elect to replace the Product or component, we will replace it with the model, version, color, Materials, or style available at the time of replacement, which may be different in certain respects than the original you purchased.

​During normal, properly supported use, this warranty shall apply only if (i) the materials of construction develop a visible indentation in the mattress greater than one (1.00) inch compared to the surrounding mattress areas after full recovery from load, or (ii) if the materials of the mattress crack, split, or otherwise fail during normal use and normal handling which is in accordance with Kingtana’s care and use instructions for the mattress .This indentation must be of large enough width and length to be
considered a body impression, and only applies to the mattress and not to settling of the cover fiber-fill materials. Generally, to measure the indentation the cover would be unzipped and removed, then a straight-edge would be set on the mattress of length to be beyond the indentation on both sides of the indentation, then a vertically placed ruler would show the depth of any indentation. The mattress must be flat on the floor to be measured (so that indentations in the mattress can be differentiated from
problems with your foundation or frame). Kingtana expects you to not experience such indentations, but if you do, it is covered under the terms of this limited warranty.

Kingtana® Mattresses are covered by warranty only if they are used on a firm, flat, solid-surface, non- spring foundation (whether non-moving type or adjustable type) sufficiently strong to remain flat and firm under the weight of the mattress and its users, from the date of delivery onward to the date of the warranty claim without interruption; otherwise the warranty is void.

Other placement (whether long or short term) of the mattress, including but not limited to foundations of other description, a storage facility in any orientation, or use of a non-sufficient frame beneath the foundation, voids this warranty. A sufficient frame on which the foundation rests must provide sturdy support for both the mattress and foundation and in the case of a queen or larger must have 5 or more legs including a center support. If you use a slatted base or slatted box foundation, the slats should not be more than 4” apart for optimal support. Kingtana may require purchaser to provide proof of the sufficiency of the foundation and frame and of the constancy since purchase of the support of the mattress and foundation thereon before this warranty will apply.

This warranty shall not apply if Kingtana determines in its reasonable discretion that the mattress or foundation has been damaged, abused, or neglected; it shall be reasonable without limitation to make such determination if the following are present: Tears, stains, odors, unsanitary conditions, folds, footprints, burns, cuts, or signs of jumping on the bed, rodents, insect damage or other infestation, damage from liquids or gels or blood or bodily fluids or other fluids, or damage from weather or sun exposure.

Kingtana highly recommends the use of a very stretchy, breathable mattress protector because without such protection your mattress may not be clean enough or undamaged enough to have this warranty apply. Please note that a non-stretchy or non-breathable mattress protector (or non-stretchy tight sheets) will negate much of the benefit of The Kingtana® mattress. For the health and safety of anyone who would be required to dispose of, or otherwise handle, the sleep set, Kingtana and its retailers or
agents may refuse to inspect such products to assess whether covered by the warranty, in which case, Kingtana reserves the right to deny warranty coverage. Photos may be requested to be sent via internet to Kingtana.

In addition to the above mentioned this limited Mattress Warranty does not cover the following: Localized firmness changes are normal and are not covered under warranty; Comfort preferences are not covered under warranty; Minor imperfections and slight cosmetic flaws, normal wear and tear, tears, stains, soiling, burns, and discoloration that occur over time, dampness or mold; The mattress must be always covered in use or the warranty is void (UV light degrades cushioning materials); Individual or personalized allergies and sensitivities, and naturally occurring cotton or foam aromas; Mattresses sold “as-is”, “preconditioned”, “reconditioned”, “used”, “comfort return”, “returned”, “previously owned”, or any other similar wording indicating that the Mattress is not “new” or of “first quality”, or has previously been purchased or used by another consumer.

Kingtana will not charge purchaser to repair or replace purchaser’s mattress if it is reasonably deemed by Kingtana to be defective according to the terms herein during the first ten (15) years since the original purchase. Any to-or-from transportation handling and costs and inspection costs associated with repairs or replacements are the responsibility of purchaser. The warranty for any repaired or replaced mattress runs from the date of original purchase and not from the date of the replacement. Whether to
repair or to replace the mattress shall be at Kingtana’s sole option. Only one mattress per house hold per year will be allowed for exchange. The cover is not part of the 15-year warranty and is separately addressed in the next paragraph.

The zippered cover of Kingtana® mattress is warranted for two (2) years from the date of purchase against faults in material or workmanship. Kingtana may choose at its sole option to replace the cover with the same or different (as one example, a different color or material) cover or to repair the cover. Purchaser is responsible for to-or-from transportation, handling and inspection costs.

Warranty Coverage Additional Limitations:
If replacement of a mattress or cover takes place, the product being replaced must be sent to Kingtana or otherwise disposed of as directed by Kingtana. KINGTANA SHALL NOT BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF ANY BREACH OF THIS WARRANTY OR RESULTING FROM THE USE OF ANY MATTRESS, COVER, FOUNDATION, FRAME, PILLOW, TOP-OF-BED PRODUCT (SUCH AS COMFORTERS, SHEETS, MATTRESS PROTECTORS OR BLANKETS) OR ACCESSORY. REPLACEMENT OR REPAIR AS SET FORTH HEREIN SHALL BE THE EXCLUSIVE REMEDY FOR BREACH OF THIS WARRANTY. THERE ARE NO EXPRESS OR IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION FITNESS FOR A PARTICULAR PURPOSE AND IMPLIED WARRANTIES OF MERCHANTABILITY. THE ONLY WARRANTY IS THE WARRANTY DESCRIBED ON THE FACE OF THIS LIMITED WARRANTY. THIS WARRANTY IS NOT EFFECTIVE IF THE PRODUCT IS USED OUTSIDE THE USA (there may be a separate warranty for non-U.S. products, but be advised that it may not be from Kingtana). Some states do not allow the exclusion or limitation of incidental or consequential damages or limitations on how long an implied warranty lasts, so limitations or exclusions herein may not apply to you. This warranty provides the original purchaser specific legal rights, and there may be other rights which vary from state to state.
